When the parents of a child divorce, the presumption is that both parents should be named joint managing conservators. It is much less uncommon for one parent to be appointed as the sole managing conservator.

If a sole managing conservator is appointed, the other parent is usually designated as a “possessory conservator,” which limits his/her rights and duties concerning child-rearing decisions that are awarded by the court. Most likely that person will still have possession and access of the children at specified times in accordance with the parenting plan.

Though a joint managing conservatorship is the norm, this does not mean that you and your former spouse will get equal possession of your child. Rather, the court generally designates one parent as the parent with the exclusive right to establish the primary residence of the child. Not surprisingly, this designation can be hotly contested.
